Online sales, individual orders and ASERIS services

§ 1. General provisions

These Terms govern the sale of goods, conclusion and performance of service contracts, placing and fulfilment of orders, payments, delivery, withdrawal from contracts and complaints in connection with the sales and service activities of ASERIS.

The Seller and Service Provider is Aseris Wojciech Miler, conducting business under the ASERIS brand, address: ul. Leśna 19 m. 11, 43-225 Wola, Poland, NIP: 6381865822, REGON: 543680230.

§ 2. Scope of activity

ASERIS sells its own and selected products and provides services, including in particular handmade jewellery, decorative products, products made of wood and plywood, laser-cut and laser-engraved products, 3D-printed products, personalised products and custom-made items.

Services may include in particular 3D printing, 3D scanning, digital design, reverse engineering, laser engraving, personalisation, preparation of designs and technical documentation, selected product repairs and selected business-support, documentation and process-related services.

The detailed scope of a specific product or service is determined by its offer, quotation or individual arrangements with the Customer.

§ 3. Customers and definitions

A Customer may be a consumer, a natural person conducting business activity, a legal person or another organisational entity.

A Consumer is a natural person concluding a transaction with the Seller for purposes that are not directly connected with that person's business or professional activity.

Where mandatory consumer-protection provisions grant specific rights also to certain sole traders, those rights apply to the extent required by applicable law.

§ 4. Sales and order channels

Orders may be concluded in particular:

  • through the ASERIS website, if online-store functionality is available,
  • by e-mail,
  • through agreed messaging or communication channels,
  • through Allegro,
  • through other sales platforms used by ASERIS,
  • on the basis of an individual quotation or order confirmation.

These Terms also apply to the ASERIS online store if and when the store functionality is activated.

§ 5. Product and service information

The description of a product or service specifies its essential characteristics, available variants and other information relevant to the Customer's decision.

Photographs and visualisations are intended to present the product as accurately as reasonably possible. Natural materials, handmade products and manufacturing processes may result in differences between individual items.

In particular, natural stones and wood may differ in colour, structure, pattern, grain or other natural characteristics. 3D-printed products may show layer lines and other normal features of additive manufacturing.

§ 6. Prices

Unless expressly stated otherwise, prices offered to consumers are gross prices including applicable VAT.

Delivery, additional services or individual modifications may be charged separately if they are not included in the product or service price.

Before the Customer becomes bound by a contract, the total price or the method of calculating it and any additional costs are communicated to the Customer in the manner required by applicable law.

§ 7. Orders placed through the website

Where online-store functionality is available, the Customer selects the goods or services, provides the information necessary to fulfil the order, selects the available payment and delivery method and confirms the order in accordance with the information displayed during checkout.

The Customer should check the order data before submitting it.

§ 8. Orders placed by e-mail or messaging services

Orders may be agreed by e-mail or another communication channel. Before the contract is concluded, ASERIS provides or confirms the essential conditions of the order, including in particular the subject of the order, price or method of calculating the price, expected completion time and, where applicable, delivery costs.

An order is considered accepted when ASERIS clearly confirms its acceptance or the parties otherwise clearly agree that the order is to be performed.

§ 9. Orders placed through Allegro and other platforms

For transactions concluded through Allegro or another external platform, these Terms apply together with the rules and technical procedures of the relevant platform.

Platform rules concerning ordering, payment, delivery, returns or complaints may determine the technical method by which particular actions are performed.

Unless the relevant offer clearly states otherwise, ASERIS remains the seller or service provider for the transaction.

§ 10. Individual and personalised orders

An individual order may be produced according to specifications provided or approved by the Customer, including dimensions, text, name, date, colour, material, design, photograph, engraving, technical parameters or other requirements.

The Customer is responsible for checking the correctness of the information and specifications provided for production before the order is approved for execution.

ASERIS may request confirmation of a design, dimensions or other important specifications before production begins.

If a proposed design may create a safety, technical or legal issue, ASERIS may propose a modification or refuse to manufacture the product in the requested form.

§ 11. Customer-provided materials

The Customer may provide photographs, graphics, texts, files, 3D models, technical drawings, measurements or other materials necessary to perform an order.

By providing such materials, the Customer declares that their use for the agreed purpose does not unlawfully infringe the rights of third parties and that the Customer is authorised to provide them.

ASERIS uses such materials primarily for the purpose of performing the relevant order.

§ 12. Payments

Available payment methods depend on the sales channel and may include bank transfer, payment services offered by an external platform or other methods indicated before conclusion of the contract.

For individual or custom-made orders, ASERIS may require full or partial advance payment if this is agreed before the order is accepted.

§ 13. Performance and completion time

The expected completion time is specified in the offer, quotation or individual arrangements.

For custom-made products and services, the completion period may begin after all information necessary for performance has been received, the design has been approved where required and any agreed advance payment has been made.

If circumstances affecting the agreed deadline arise, ASERIS informs the Customer as soon as reasonably possible.

§ 14. Delivery and collection

Products may be delivered using the delivery methods offered for the relevant order or collected personally where such option has been agreed.

Delivery costs are communicated before the Customer becomes bound by the contract.

The Customer should provide correct delivery details and ensure that the shipment can be received at the indicated address or collection point.

§ 15. Consumer right of withdrawal

A Consumer who concludes a distance contract may, subject to statutory exceptions, withdraw from the contract within 14 days without giving a reason.

To exercise the right of withdrawal, the Consumer must submit an unequivocal statement of withdrawal before expiry of the applicable period.

The Consumer may use the model withdrawal form included at the end of these Terms, but use of the form is not mandatory.

§ 16. Exceptions to the right of withdrawal

The right of withdrawal does not apply in cases provided for by mandatory law, including in particular contracts for the supply of goods made to the Consumer's specifications or clearly personalised.

This may include products made with an individual name, inscription, dimensions, design, engraving or other specification determined by the Consumer.

For services fully performed before the expiry of the withdrawal period, the right of withdrawal may cease where the statutory requirements concerning the Consumer's prior request, consent and acknowledgement have been met.

For digital content not supplied on a tangible medium, the right of withdrawal may cease when performance begins with the Consumer's prior express consent and acknowledgement of the resulting loss of the right of withdrawal, where required by law.

§ 17. Consequences of withdrawal and return of goods

Where the Consumer validly withdraws from a contract, payments are refunded in accordance with applicable law.

Unless the Seller has offered to collect the goods, the Consumer should return the goods without undue delay and within the statutory time limit.

The Consumer is responsible for any diminished value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics and functioning.

§ 18. Complaints concerning goods

ASERIS is liable for conformity of goods with the contract to the extent required by applicable consumer law.

A complaint should contain information enabling the order and the reported issue to be identified. Photographs may be attached if they help to assess the issue.

The absence of optional information does not deprive the Consumer of statutory complaint rights where the complaint can otherwise be examined.

§ 19. Complaints concerning services

If the Customer believes that a service has not been performed in accordance with the contract, the Customer may submit a complaint describing the issue and the expected solution.

ASERIS assesses the complaint on the basis of the agreed scope of the service, materials supplied by the Customer and other relevant circumstances.

§ 20. Digital content and files

Where the subject of an order includes a digital file, such as a design, model, graphic, technical file or other digital content, the scope and permitted use of that file are determined by the offer or individual arrangements.

Unless otherwise agreed, transfer of a digital file does not automatically transfer copyright or other intellectual-property rights beyond the scope necessary for the Customer's agreed use.

§ 21. Intellectual property

Designs, graphics, photographs, descriptions, documentation, models and other materials created by ASERIS may be protected by copyright or other intellectual-property rights.

Their use beyond the scope resulting from the contract requires an appropriate legal basis or agreement with ASERIS.

§ 22. Product safety

Products should be used in accordance with their intended purpose, product description and any instructions or safety warnings provided with the specific product.

General product-safety information is available on the ASERIS website. Product-specific warnings and instructions take precedence where they provide more detailed information.

§ 23. Personal data

Rules concerning the processing of personal data are described in the ASERIS Privacy Policy.

§ 24. Business customers

For contracts concluded with customers acting exclusively in the course of their business or professional activity, the parties may agree individual terms that differ from these Terms to the extent permitted by law.

Nothing in these Terms excludes or limits rights that cannot lawfully be excluded or limited.

§ 25. Applicable law and final provisions

These Terms are governed by Polish law, without depriving Consumers of mandatory protection granted to them under applicable provisions that cannot be excluded by agreement.

If any provision of these Terms becomes invalid or ineffective, the remaining provisions remain in force to the extent permitted by law.

The current version of these Terms is published on the ASERIS website together with the date of the latest update.

Appendix No. 1 — Model withdrawal form

This form should be completed and returned only if the Consumer wishes to withdraw from the contract.
